The elevator is frequently out of order and the lawn is not well kept. Can I stop paying my monthly maintenance until they resume proper maintenance? A: No. This is a common misunderstanding that gets a lot of people into trouble. You must pay your association dues as they come due even though you are unsatisfied at the quality of maintenance performed by your board. If you don’t pay, your association as the right to file a lien against your unit and ultimately foreclose on the lien.

Besides timely submitting my letter of intent and information sheet are there any other requirements, specifically educational requirements? A: At this time, potential board members have two options in this regard.

Option 1: Newly elected board members can chose to forgo a formal educational course and simply certify in writing to the association secretary that he/she has read the association’s governing documents, will work to uphold such documents and policies, and will faithfully discharge his fiduciary responsibility to the association’s members;

or

Option 2: Candidates can take a Division-approved educational course up to one (1) year prior to or within 90 days after the date of such member’s election. (The Division was described in the blog the week ending October 14th). The courses vary in length, cost and location.
